We have successfully launched a number of investment funds.  One key question that needs to be answered is 'What Jurisdiction?'.  This is a complex area that is subject to an increasing degree of regulation, and there is an often bewildering choice of jurisdictions.  In our view the choice of jurisdiction should based on 3 key considerations: commercial, regulatory and tax.

In general the more sophisticated the investor, the less onerous the regulation of the fund and vice versa.  Other regulatory considerations to be borne in mind include: fund manager licence, promotions regulations and anti-money laundering rules.  Special rules apply to US investors, and specialist advice should be sought in this case.
